and Conditions
of new Spirit Dakhla Watersports

Opening hours

The New Spirit Dakhla water sports center is open daily from 10 a.m. to 7 p.m.

Services (rescue boat, launching and landing assistance, rental) are provided until 6:30 p.m.


Use of the spot and all center services is permitted exclusively during official opening hours. Outside operating hours, there is no supervision or rescue service. Kitesurfing and wingfoiling outside opening hours is prohibited.

Payment Terms

Payment must be made on the first day at the center. Any subsequent invoices must be settled by 5:00 p.m. on the day of departure.


New Spirit Dakhla accepts cash or credit card payments (Euros, MAD).


KBC World vouchers can be used exclusively for KBC services (rental, lessons, and storage/beach use).

Liability Disclaimer

New Spirit Dakhla provides its services with the greatest possible care. Nevertheless, water sports inherently involve risks that cannot be completely eliminated even when all safety standards are strictly
observed. By signing, the participant confirms that they are aware of and accept the risks associated with water sports.


New Spirit Dakhla assumes no liability for personal injury or property damage caused by slight negligence. Liability for intent, gross negligence, injury to life, body, or health, as well as mandatory statutory
claims, remains unaffected.


New Spirit Dakhla accepts no liability for loss, damage, or theft of personal belongings, including items stored in lockers or guest storage.


Participants are informed that they must take out adequate personal insurance (in particular accident and personal liability insurance).


For minors: participation is only permitted with the consent and signature of a legal guardian.

Health & Personal Responsibility

Participation in lessons, rental, and use of the spot is at the participant’s own risk.

 

Each participant/renter is obliged to strictly follow the safety instructions of the staff, use equipment responsibly, and avoid endangering themselves or others.


The participant confirms that they are not aware of any medical conditions that could make participation dangerous. Health risks, specific illnesses, or limitations must be reported immediately to the New Spirit Dakhla staff. Participants are required to inform the New Spirit Dakhla team immediately of any injury or discomfort.


Participation under the influence of alcohol, drugs, or performanceimpairing medication is not permitted.

Courses and Course Execution

Courses generally start at 10 a.m. on the first booked day.

 

If the practical part cannot take place due to excessively strong (>25 knots) or weak (<12 knots) wind, the course will be postponed or replaced by
a voucher of equivalent value. The KBC Event Week is excluded from this: if the practical part is not possible, an alternative program will be offered.


New Spirit Dakhla is not obliged to refund course fees if a customer decides to discontinue the course for personal reasons.

Sports Equipment and Rental

If the renter is not sufficiently qualified to use the equipment safely, New Spirit Dakhla may refuse rental. New Spirit Dakhla is entitled to terminate the contract and retain the rental fee.


The renter is liable for damage or loss and bears the costs. Any damage must be reported upon return.
The New Spirit Dakhla team regularly inspects and maintains the equipment. Nevertheless, the participant is responsible for ensuring that their equipment is in technically sound condition and agrees to carefully check the equipment before each use, immediately report any defects or doubts, and use only suitable, functional equipment.


Mandatory safety equipment (e.g. , helmet, impact vest, leashes) must be worn as specified by the center.


The renter is obliged to return the rental equipment by 6 p.m. at the latest.

Equipment Insurance

The New Spirit Dakhla equipment insurance (if chosen) covers damage up to €300 per claim, without deductible. The renter is liable for damages exceeding this coverage amount.


Loss of equipment is not insured.


The insurance does not cover damage occurring in winds over 25 knots (neither on land nor on water) or during extremely low tide. Damage to directional boards (e.g., broken fin) and foil equipment is not covered by this insurance. The insurance covers only damage caused by the policyholder to the rented equipment, not damage to persons or equipment belonging to other kiters.

Safety Rules

Participants are informed that the use of kites and wings always involves a residual risk—even under professional instruction and with inspected equipment. Contract partners are obliged to follow all instructions
given by New Spirit Dakhla staff.

 

  • Independent launching and landing is not permitted.

  • When launching and landing a kite at the water’s edge,

  • the kiter must be at least 20 meters (kite line length) in the water.

  • Keeping a kite in the air on land is strictly prohibited.

  • All participants must comply with international right-of-way rules

  • (posted at the center).

  • Each kitesurfer must always maintain a minimum distance of

  • 50 meters from other kiters, especially beginners.

  • Jumping with the kite within 50 meters or less of the beach is

  • prohibited.

  • The rescue boat operates exclusively in deep water behind the

  • reef within a radius of 500 meters around the station,

  • including 150 meters downwind.

  • Kitesurfing or wingfoiling outside the safety area

  • (500-meter radius around the station) is not permitted.

  • In the event of dangerous weather or wind conditions, official

  • warning signals, or instructions from the center team, all activty

  • must be stopped and participants must return to shore.

  • Accidents or injuries must be reported to the center immediately; an accident report must be completed.

 

New Spirit Dakhla reserves the right to exclude individuals from participation (courses, rental, beach use) if safety is endangered. Such exclusion does not entitle the participant to a refund if the decision
is made for safety reasons.

Photos and Videos

I agree that photos and videos of me taken at New Spirit Dakhla may be used publicly for commercial purposes (e.g. , website, print advertising, New Spirit Dakhla and KBC World social media channels).

Storage of My Data

I am informed that my data will be stored by New Spirit Dakhla and passed on to the booking systems Kitehub and/or LEAO of Nerdsquad UG (limited liability) so that all booked services can be properly planned and carried out.


The following data will be stored: first name, last name, period of stay, email address, booked services, billing address, date of birth, telephone number, and accommodation.


The data will be stored until further notice and automatically deleted after 10 years, unless other statutory retention periods apply. Data can be accessed at any time upon request via email to team@kbcworld.com , and a copy, deletion, or correction can be requested. In addition, the right exists to contact the competent data protection
authority.

Severability Clause

The respective national law applicable at the center’s location shall apply additionally. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected. Invalid provisions shall be replaced by valid ones that most closely reflect the intended economic purpose.

Conclusion of Contract and Cancellation

By signing, the participant confirms that they have understood all New Spirit Dakhla safety rules and will comply with them.


Participants undertake to follow the instructions of instructors and center staff. KBC does not provide insurance for personal risks.


The booking is binding.

The following cancellation fees apply:

  • 21 to 8 days before planned arrival: 25%

  • 8 days to 1 day before planned arrival: 50%

  • On the day of arrival or in case of no-show: 100%


By signing the registration papers or by providing an electronic signature during the online registration process, the participant confirms that they have read, understood, and agree to comply with these general terms and conditions.
